Prospect Engine ("we," "us," "our") is a service operated by Lightning Labs. 01Information We Collect

Information you provide directly

When you fill out a form on our website, request a demo, contact us, or sign up for our services, we may collect:

  • Name and business name
  • Email address and phone number
  • Business website URL and industry
  • Any other information you choose to share in form fields or messages

Information collected automatically

When you visit our website, we automatically collect certain technical information, including:

  • IP address and approximate geographic location
  • Browser type, device type, and operating system
  • Pages viewed, time on page, and referring URL
  • Cookies and similar tracking technologies (see Section 04)

Information from third-party data sources

We may obtain contact and demographic information about prospective customers from third-party data providers and marketing list vendors. This data is used to identify business owners who may benefit from our services and to build advertising audiences. If you believe your information was provided to us through a third-party source and you'd like it removed, please use the contact methods in Section 09.

We use the information we collect for the following purposes:

  • Service delivery: To respond to inquiries, deliver demos, build websites, and provide ongoing care and hosting.
  • Communication: To send transactional emails, project updates, and occasional marketing communications you can opt out of at any time.
  • Marketing and advertising: To create and serve targeted advertisements through platforms like Meta (Facebook/Instagram) and Google, including the use of custom audiences and lookalike audiences.
  • Analytics: To understand how visitors use our website and improve our services.
  • Legal compliance: To comply with applicable laws, respond to lawful requests, and protect our rights.

03How We Share Your Information

We do not sell your personal information in the traditional sense. However, we share information with the following categories of recipients to operate our business:

  • Advertising platforms: Meta Platforms, Inc. (Facebook/Instagram) and Google LLC, for the purpose of audience targeting, lookalike modeling, and conversion measurement. Information shared is typically hashed (encrypted) before transmission.
  • Analytics providers: Google Analytics, for website performance measurement.
  • Service providers: Hosting providers (e.g., Netlify), email services, payment processors, and other vendors who support our operations under confidentiality obligations.
  • Legal requirements: Law enforcement or regulatory authorities, where required by law or to protect rights, safety, or property.
  • Business transfers: In the event of a merger, acquisition, or sale of business assets, your information may be transferred to the successor entity.
Note: Under California law, sharing data with advertising platforms for targeted advertising may be considered a "sale" or "sharing" of personal information. See Section 06 for your opt-out rights.

04Cookies & Tracking Technologies

We and our partners use cookies, pixels, and similar technologies to operate our website, measure performance, and deliver targeted advertising. The primary tracking tools we use include:

  • Google Analytics 4: Measures website usage and traffic patterns.
  • Meta Pixel: Enables advertising attribution and audience-building on Facebook and Instagram.
  • Google Tag Manager: Manages the deployment of marketing and analytics tags.
  • Functional cookies: Required for basic website operation.

You can control cookies through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent. Note that disabling cookies may affect site functionality.

05Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Specifically:

  • Inquiry and prospect data: Up to 36 months from last interaction.
  • Customer data: Duration of the customer relationship plus 7 years for tax and accounting compliance.
  • Marketing data from third-party sources: Up to 24 months, refreshed periodically.
  • Analytics data: Per the retention settings of the analytics provider (typically 14–26 months).

You may request earlier deletion of your data at any time, subject to legal and operational constraints.

06Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with the following rights:

  • Right to know: Request disclosure of the categories and specific pieces of personal information we have collected about you.
  • Right to delete: Request deletion of personal information we have collected about you, subject to certain exceptions.
  • Right to correct: Request correction of inaccurate personal information.
  • Right to opt out of sale or sharing: Opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising.
  • Right to limit use of sensitive personal information: Limit how we use sensitive personal information (we do not currently use sensitive personal information for purposes that trigger this right).
  • Right to non-discrimination: Not be discriminated against for exercising these rights.

To exercise any of these rights, contact us using the information in Section 09. We will verify your identity before processing requests and will respond within the timeframes required by law (typically 45 days).

Do Not Sell or Share My Personal Information

To opt out of the sale or sharing of your personal information for advertising purposes, email us at hello@tuskcreativestudios.com with the subject line "Do Not Sell or Share." We will honor your request within 15 business days. You may also enable Global Privacy Control (GPC) signals in your browser, which we honor as a valid opt-out request.

07Other Privacy Rights

Depending on your location, you may have additional rights under laws such as the EU General Data Protection Regulation (GDPR), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), or similar laws. These rights generally include access, correction, deletion, portability, and the right to object to certain processing.

To exercise any of these rights, contact us at hello@tuskcreativestudios.com. We do not knowingly process the personal information of children under 13.

08Data Security

We use reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.
